Business owners and workers alike may think that an independent contractor relationship is a win-win. However\, misclassifying a worker as an "independent contractor" when they are legally considered an "employee" opens employers up to significant liability. Most people don't realize that whether you agree in a contract\, or whether you pay someone on a 1099 is not the deciding factor\, because the law defines both of these classifications. In this program\, Valerie will discuss how to determine whether a person you hire should be an employee\, even if they want to be an independent contractor\, the risks of getting it wrong\, and ways to avoid getting in trouble.\n\n\n\nAbout Presenter Valerie Ferrier\n\n\n\nValerie K. Ferrier has been an employment lawyer for fifteen years and is Co-Chair of the Labor & Employment Practice Group at Kane Kessler\, P.C. She works with business owners to help them understand and comply with the law in multiple jurisdictions. Valerie drafts employment and separation agreements and employee handbooks\, conducts anti-harassment training\, defends overtime and discrimination cases\, and provides advice to clients.
